DIRECT BOOKING RENTAL AGREEMENT & GUEST TERMS:
By completing a reservation, electronically accepting these terms, or occupying the Property, the person making the reservation (“Guest”) agrees to this Rental Agreement (“Agreement”) on behalf of Guest and all members of Guest’s party.
The specific property, rental dates, number of guests, rental charges, taxes, fees, deposits, and other reservation-specific information shown during booking or in the reservation confirmation are incorporated into this Agreement.
1. RENTAL PROPERTY AND TERM
Guest is granted temporary use and occupancy of the property identified in the reservation (“Property”) for the dates stated in the reservation confirmation.
Unless otherwise stated:
Check-in: 4:00 PM
Check-out: 10:00 AM
Early arrival or late departure requires prior approval.
This Agreement does not convey ownership or any other interest in the Property. For transient or vacation stays, the Property is provided solely as temporary lodging and is not intended to establish permanent residency.
2. PAYMENT
Guest agrees to pay all rental charges, taxes, cleaning fees, deposits, and other charges disclosed at the time of booking.
The reservation is not confirmed until Owner receives any required initial payment.
Guest authorizes Owner or its payment processor to charge the payment method provided for amounts authorized under this Agreement, including the reservation balance and charges resulting from damage, missing property, excessive cleaning, unauthorized guests or pets, or other amounts properly due under this Agreement, subject to applicable law.
3. CANCELLATION AND REFUNDS
The cancellation policy displayed and accepted by Guest at the time of booking is incorporated into this Agreement.
Refunds, credits, and cancellations will be handled according to that policy.
No refund will be provided for late arrival, early departure, unfavorable weather, personal circumstances, or conditions outside Owner’s reasonable control unless otherwise required by law or expressly provided in the applicable cancellation policy.
4. OCCUPANCY
Occupancy may not exceed the maximum number of guests stated in the reservation or property listing.
Only registered guests may stay overnight at the Property.
Guest is responsible for the conduct of all occupants, visitors, children, and invitees while at the Property.
The person making the reservation must be at least the minimum booking age stated for the Property and must remain responsible for the reservation throughout the stay.
5. USE OF PROPERTY
The Property may be used only for lawful residential lodging purposes.
Unless specifically authorized by Owner, the following are prohibited:
• Parties, receptions, or large gatherings
• Commercial activities, filming, or events
• Illegal activity
• Excessive noise or disturbances
• Conduct that creates a nuisance or unreasonable risk to the Property, neighbors, or community
• Exceeding occupancy or parking limitations
Guest agrees to comply with all applicable laws, ordinances, association rules, parking requirements, quiet hours, and property-specific rules provided before or during the stay.
6. PETS
Pets are permitted only when specifically approved for the Property and included in the reservation.
Unauthorized animals may result in additional cleaning or damage charges and, when permitted by law, termination of occupancy.
Nothing in this section limits rights concerning service animals or other assistance animals protected by applicable law.
7. SMOKING AND VAPING
Smoking and vaping are prohibited inside the Property.
Guest is responsible for reasonable costs necessary to remediate smoke, odor, burns, or other damage caused by violation of this provision.
8. CONDITION OF PROPERTY
Guest agrees to promptly notify Owner of significant damage, unsafe conditions, maintenance problems, or missing or malfunctioning items discovered during the stay.
Guest shall not make repairs, alterations, improvements, or modifications to the Property without Owner’s authorization except as otherwise permitted by applicable law.
9. DAMAGE AND EXCESSIVE CLEANING
Guest is responsible, to the extent permitted by law, for damage to the Property or its contents caused by Guest, members of Guest’s party, visitors, or pets beyond ordinary wear and tear.
Guest may also be responsible for reasonable costs resulting from:
• Missing or damaged property
• Excessive cleaning
• Unauthorized pets
• Unauthorized occupants
• Smoking or vaping violations
• Damage caused by negligence or misuse
• Failure to return keys, remotes, passes, or other provided items
Any security deposit will be administered and returned in accordance with applicable law.
10. HOUSEKEEPING
Unless otherwise stated, daily housekeeping is not provided.
Guest agrees to leave the Property in reasonably clean condition, place trash in designated locations, and follow checkout instructions.
The standard cleaning fee does not cover extraordinary cleaning, removal of excessive trash, remediation of smoke or pet damage, or restoration following misuse of the Property.
11. AMENITIES AND OUTDOOR AREAS
Guest understands that use of amenities such as docks, waterfront areas, pools, hot tubs, bicycles, kayaks, grills, fireplaces, fire pits, stairs, decks, playground equipment, or other recreational features involves ordinary risks.
Guest is responsible for appropriately supervising children and exercising reasonable care.
Guest must follow posted instructions and property rules concerning amenities.
Nothing in this Agreement releases Owner from liability that cannot legally be waived.
12. WATERFRONT PROPERTIES
If the Property is located on or near water, Guest acknowledges that waterfront environments present inherent risks, including changing water depth, currents, weather, slippery surfaces, docks, boats, and other natural conditions.
Children and inexperienced swimmers must be appropriately supervised.
Guest is responsible for determining whether conditions are appropriate for Guest’s intended recreational activity.
13. OWNER ACCESS
Owner, property manager, maintenance personnel, or authorized contractors may enter the Property as reasonably necessary and as permitted by applicable law, including for emergencies, requested repairs, maintenance, protection of the Property, or other lawful purposes.
For non-emergency access during longer residential occupancies, applicable landlord-tenant law controls.
14. UTILITIES AND INTERRUPTIONS
Owner will make reasonable efforts to provide advertised utilities and amenities.
Temporary interruptions involving electricity, internet, television, water, appliances, weather-related services, community amenities, or other services outside Owner’s reasonable control do not automatically entitle Guest to a refund.
Owner will make reasonable efforts to address material problems reported during the stay.
15. WEATHER AND NATURAL CONDITIONS
Guest accepts ordinary weather and environmental conditions associated with the Property's location, including rain, snow, ice, storms, heat, insects, wildlife, water conditions, and seasonal conditions.
Guest is responsible for monitoring weather and emergency information and following government evacuation orders.
If the Property becomes legally unavailable for occupancy or materially uninhabitable, Owner and Guest will address cancellation, relocation, or refund obligations as required by applicable law and the circumstances.
16. PERSONAL PROPERTY
Guest is responsible for Guest’s personal belongings.
Owner is not responsible for loss, theft, or damage to personal property except to the extent liability is imposed by applicable law.
Guest should secure vehicles and personal belongings and obtain appropriate travel or renters insurance when desired.
17. SAFETY
Guest agrees not to disable or tamper with smoke detectors, carbon monoxide detectors, security equipment, pool safety equipment, fire extinguishers, or other safety devices.
Guest shall immediately report any malfunctioning safety equipment.
18. CAMERAS AND MONITORING DEVICES
The Property may utilize disclosed exterior security cameras, doorbell cameras, noise-monitoring devices, or other lawful exterior/property-protection technology.
No surveillance camera will be placed inside private living or sleeping areas.
Any monitoring technology will be used in accordance with applicable law.
19. NO GUARANTEE OF PERSONAL SUITABILITY
Guest is responsible for reviewing the property description, photographs, amenities, location, accessibility information, and house rules before booking.
Guest should contact Owner before booking if a particular feature or accommodation is essential to the stay.
20. VIOLATION OF AGREEMENT
Material violation of this Agreement, applicable law, or property rules may result in termination of occupancy when permitted by law.
Guest remains responsible for amounts lawfully due under the reservation and for damages resulting from the violation.
Owner will not use self-help removal or eviction procedures where prohibited by applicable law.
21. MICHIGAN PROPERTIES
For Property located in Michigan, Michigan law governs this Agreement.
For transient vacation or tourist accommodations, the parties intend the occupancy to constitute temporary lodging rather than a residential tenancy to the extent permitted by Michigan law.
If the nature or duration of an occupancy causes Michigan residential landlord-tenant law to apply, applicable Michigan law controls over any inconsistent provision of this Agreement.
22. FLORIDA PROPERTIES
For Property located in Florida, Florida law governs this Agreement.
When the Property qualifies as a transient public lodging establishment or vacation rental under Florida law, the occupancy is intended to constitute transient lodging.
If the nature or duration of an occupancy causes the Florida Residential Landlord and Tenant Act or another residential-tenancy law to apply, applicable Florida law controls over any inconsistent provision of this Agreement.
23. LONGER STAYS
Owner may require Guest to execute a separate lease, addendum, security-deposit disclosure, or other documentation for extended stays.
If a separate lease or addendum is required, that document and this Agreement will be read together. If the documents conflict, the provision required by applicable law or the more specific provision concerning the extended stay will control.
24. LOCAL RULES
Individual properties may be subject to city, township, county, condominium, homeowners association, licensing, occupancy, parking, noise, trash, or other requirements.
Property-specific rules provided in the listing, booking confirmation, digital guest book, or other written communication are incorporated into this Agreement.
25. FORCE MAJEURE
Owner is not responsible for delays, interruptions, or inability to provide occupancy resulting from events outside Owner’s reasonable control, including severe weather, natural disasters, governmental orders, utility failures, or other extraordinary events.
This provision does not eliminate any refund, cancellation, habitability, evacuation, or other rights that cannot legally be waived.
26. SEVERABILITY
If any provision of this Agreement is determined to be invalid or unenforceable, the remaining provisions will remain effective to the fullest extent permitted by law.
27. ENTIRE AGREEMENT
This Agreement, together with the reservation confirmation, cancellation policy, property-specific rules, and any applicable addendum, constitutes the agreement between Guest and Owner concerning the reservation.
Any modification must be agreed to in writing.
28. ELECTRONIC ACCEPTANCE
Guest acknowledges that electronic acceptance of this Agreement constitutes Guest’s agreement to its terms.
By selecting “I Agree,” “Accept Rental Agreement,” “Complete Booking,” or similar language during checkout, Guest confirms that Guest:
• Has read and understands this Agreement;
• Has reviewed the cancellation policy and property-specific rules;
• Agrees to be legally bound by these terms;
• Is authorized to make the reservation; and
• Accepts responsibility for ensuring all members of the reservation party comply with these terms.
